PHOTO REVIEW, CONSENT, AND USER RESPONSIBILITY
Ok2Share provides a technology platform designed to allow event participants to privately view event photographs and communicate whether they are comfortable with particular photographs being shared. The Ok2Share approval process, including its anonymous feedback features, is intended solely as a communication and review tool for event participants.
Ok2Share does not independently obtain, verify, monitor, or enforce consent among event participants. The absence of an objection, thumbs-down, or other negative response to a photograph does not constitute a legal release, waiver, license, or other legally binding consent by any person appearing in a photograph.
Users and event participants are solely responsible for determining whether they have all permissions, consents, releases, and other rights necessary to upload, download, distribute, publish, post, reproduce, or otherwise use any photograph or other content made available through the Service.
SHARING OF PHOTOS WITHOUT CONSENT
Ok2Share is not responsible or liable for any photograph or other content that is downloaded, copied, captured, forwarded, published, posted to social media, distributed, or otherwise shared by an event creator, participant, or other third party, whether or not such sharing occurs contrary to another participant’s wishes or without that participant’s consent.
Once content has been accessed, downloaded, copied, captured, or otherwise obtained by a user or third party, Ok2Share has no control over the subsequent use, disclosure, distribution, reproduction, or retention of that content.
Users agree that they are solely responsible for their own use and sharing of photographs and for complying with all applicable privacy, publicity, copyright, intellectual-property, and other applicable laws.
LOSS, DELETION, OR UNAVAILABILITY OF PHOTOS
Ok2Share is not a permanent photo-storage, archival, backup, or preservation service. Users are solely responsible for maintaining their own copies and backups of photographs and other content.
To the fullest extent permitted by applicable law, Ok2Share and its owners, affiliates, officers, employees, contractors, and service providers shall not be responsible or liable for the loss, deletion, corruption, alteration, unauthorized access, failure to upload or download, interruption, expiration, or other unavailability of photographs, files, data, or other content, regardless of cause.
Users acknowledge that photographs and other content may be automatically deleted or become unavailable following the applicable event review or storage period.
NO GUARANTEE OF PARTICIPANT APPROVAL OR COMPLIANCE
Ok2Share is designed to facilitate communication among event participants regarding photographs they are comfortable sharing. Ok2Share does not guarantee that every person depicted in a photograph has viewed the photograph, responded to it, consented to its use, or will comply with the preferences expressed by other participants.
The Service should not be relied upon as a substitute for obtaining any consent, authorization, model release, parental or guardian permission, or other legal permission that may be required for a particular use of a photograph.
ASSUMPTION OF RISK AND LIMITATION OF LIABILITY
By using Ok2Share, users acknowledge and accept the risks inherent in uploading, storing, reviewing, downloading, and electronically sharing photographs.
To the fullest extent permitted by applicable law, Ok2Share shall not be liable for any claims, damages, losses, liabilities, costs, or expenses arising from or related to: (a) lost, deleted, damaged, corrupted, or unavailable photographs or data; (b) the unauthorized or unwanted sharing, publication, copying, downloading, capture, or distribution of photographs; (c) a participant’s failure to review or object to a photograph; (d) reliance upon the Ok2Share approval process as evidence of legal consent; or (e) the acts or omissions of event creators, participants, invitees, or other third parties.
Use of the Service constitutes acknowledgment that Ok2Share provides a platform for facilitating participant photo review and communication and does not assume responsibility for the subsequent actions of individual users.
